PODGORICA, 29.11.2017 – The Constitutional Court of Montenegro adopted a constitutional complaint filed due to an ineffective investigation on attempted murder of a journalist Tufik Softić.
The Court found that Softić was violated the right to life guaranteed by the European Convention for the Protection of Human Rights and Fundamental Freedoms due to an ineffective investigation of the case by the Basic State Prosecutor’s Office in Berane and Higher State Prosecutor’s Office in Bijelo Polje.
The Court allocated Softić, who was attacked in 2007 in front of his house and perpetrators had never been found, a compensation of €7,000.
All judges of the Constitutional Court voted for determination of the violation of the said right, while the majority voted for just satisfaction.
The constitutional appeal was filed by lawyer Dalibor Tomović in cooperation with Human Rights Action and Media Legal Defence Initiative from London.
The Basic Court in Podgorica had also, before this decision, allocated compensation of €7,000 to Softić because of the ineffective investigation of the attack.
