Patient Rights Protector: Raičković’s rights were violated

The Quality Control Service of the Montenegrin Clinical Center (Patient Rights Protector) has determined that the rights of patient Ana Raičković were violated when, attorney Danilo Mićović submitted her medical documentation, which he obtained illegally, during a hearing before the Basic Court.

“Regarding your letter dated April 2, 2025, I inform you that the Quality Control Service of the Clinical Center (Patient Rights Protector) conducted a procedure to obtain all necessary information and established that there was a violation of the patient’s rights. I also inform you that all collected materials have been forwarded to the Assistant Director for Legal and Human Resources Affairs of the institution (the legal department of the Clinical Center) for further action,” stated the response to the Trade Union of Media of Montenegro, signed by the authorized representative of the Director for Quality Control, doctor Ivana Čurović Šoškić.

According to Pobjeda, attorneys Danilo Mićović and Marta Šćepanović, who are defending the people charged with the assault on Pobjeda journalist Ana Raičković, misused her personal data and violated her patient rights by submitting her medical documentation to Judge Ilija Radulović during the hearing, and by requesting it to be admitted as evidence.

Due to this action by the defense, the Basic State Prosecutor’s Office initiated proceedings concerning the misuse of personal, protected documentation.

At the time, attorney Mićović proposed that the specialist’s report — reading the doctor’s name aloud — should be admitted as evidence. He also proceeded to comment on the nature of the symptoms and specify the diagnosis.

However, it was already entirely clear that the Law on Personal Data Protection had been violated. Upon the injured party’s representative stating that the document was illegally obtained and protected, Judge Radulović rejected the proposal to admit the controversial report as evidence.

Data Protection Agency Investigating the Misuse

The Agency for the Protection of Personal Data is investigating how Ana Raičković’s highly protected personal data — her medical records — ended up in the possession of unauthorized individuals, namely, the defense attorneys for Bećirović, Mijatović, and Dukić.

In response to this case, the Association of Professional Journalists of Montenegro also expressed protest and requested that both the Agency and the Prosecutor’s Office determine how the misuse occurred, whether it constitutes a criminal offense, and who is responsible. They submitted a complaint to the Bar Association of Montenegro regarding the conduct of attorneys Mićović and Šćepanović.

The Assault

Raičković was attacked on November 10 of last year in front of the “Gurman” restaurant, along with her son Uroš Gagović and fiancé Tomo Arapović. Raičković was insulted, threatened, forcibly pulled out of the car, strangled, dragged by her hair, and had her car window broken.

The accused denied that the incident occurred when the police arrived following Raičković’s report and later claimed during the trial that they did not know Raičković was a journalist and that no one insulted, threatened, or touched her.

All of these claims were contradicted by a recording from her phone, which was reviewed during the last hearing and clearly captured vile insults hurled at her by businessman Zoran Bećirović and his bodyguard Mladen Mijatović.

So far in the proceedings, surveillance footage from a nearby building near “Gurman” has been reviewed, and an expert medical report by forensic specialist Krsto Nikolić confirmed that the Pobjeda journalist sustained injuries to her neck and hand.

During the proceedings, four witnesses were heard, all of whom claimed they did not hear Bećirović and Mijatović insulting, threatening, or physically assaulting Raičković.
