AJM promoted the analysis “The Impact of the Law on Copyright and Related Rights on the Work of Journalists, Photo-Reporters and Media Workers”

SKOPJE, 15.10.2018 – The Association of Journalists of Macedonia today promoted the publication “The Impact of the Law on Copyright and Related Rights on the Work of Journalists, Photo-Reporters and Media Workers”. In it, the authors, Ivan Breshkovski and Igor Markovski give an overview of the importance of copyright for the work of journalists and media workers.

The president of AJM Naser Selmani spoke at the presentation of the analysis, and said that the Association decided to prepare this analysis due to the fact that there is massive violation of the copyrights of the journalists and media workers in the media.

“We believe that copyright infringement directly contributes to the poor social status of journalists, and from journalists and media worker’s work, usually profit those who violate their rights,” Selmani said. He added that this analysis aims to raise the awareness among state institutions for the great importance of respecting the copyrights in the media, as this directly affects the quality of journalism and the freedom of the media.

One of the authors of the analysis, the lawyer Ivan Breshkovski, at the promotion said that this publication gives a brief historical review of the development of copyrights, ie the evolution of regulations in that area in Europe and the world. According to Breshkovski, the publication clarifies those parts of the Macedonian Law on Copyright and Related Rights which are important for the work of journalists and media workers.

“The promotion of copyright protection is important when it comes to respecting journalistic products by guaranteeing the ownership of journalistic texts, photographs, audio visual contents, columns, interviews and other journalistic products and the guarantee of the Material Rights of the journalist from his work,” Breshkovski said. He added that the analysis is intended for all stakeholders in the media sector, such as the justice sector and the general public, in order to increase the awareness of the importance of copyright in the creation and distribution of media content.

This analysis was made with the help of the Konrad Adenauer Foundation.

Mijatović: Od 1992. ubijeno 150 novinara u zoni SE

BEOGRAD, 15.10.2018. – Sloboda štampe i bezbednost novinara su već godinama u sve lošijem stanju, izjavila je Istinomeru komesarka Saveta Evrope za ljudska prava Dunja Mijatović.

Mijatović je predočila da je u zoni Saveta Evrope od 1992. godine ubijeno više od 150 novinara.

Nekažnjivost takvih zločina utiče na slobodu govora i slobodu medija u mnogim zemljama, upozorila je Mijatović i pozvala evropske vlade da zauzmu ozbiljniji stav pri sprovođenju standarda ljudskih prava, a koje su usvojili u vezi sa bezbednošću novinara i drugih medijskih aktera.

Trebalo bi da preduzmu izvodljive i realistične mere kako bi se drastično podigao nivo bezbednosti novinara, objasnila je ona i predočila da je to moguće, ukoliko postoji politička volja. Nažalost, mnogi političari su u najboljem slučaju ravnodušni prema pretnjama koje dobijaju novinari. U najgorem slučaju, oni su ti koji huškaju na nasilje i produbljuju nepoverenje prema medijima, što je neprihvatljiva praksa, poručila je Mijatović.

Prema njenom stavu, pretnje prema novinarima ne poznaju nacionalnost, to je jezik kriminalaca koji žele da kriju ilegalne poslove pod velom tajni. Problem je u tome što državna vlast ne reaguje brzo i efikasno, čime utire put daljim napadima na novinare, pa se, u nedostatku konkretnih akcija države, počinioci osećaju moćno i nedodirljivo i vrlo često prođu nekažnjeno, ukazala je Mijatović.

Upitana da li se Evropska unija (EU) pravi da ne vidi kakva je situacija sa medijima u Srbiji, ona je odgovorila da ne može da govori u ime EU, ali da sistematski skreće pažnju na slobodu medija i bezbednost novinara.

Iz tog razloga sam u stalnom kontaktu sa novinarima, njihovim udruženjima i nevladinim organizacijama koje rade na njihovoj zaštiti. Delim njihovu zabrinutost u vezi sa situacijom u Srbiji i ostalim zemljama, naglasila je Mijatović.

Ona je podsetila da u svojstvu komesarke još nije posetila Srbiju, ali je primetila da su njeni prethodnici izrazili zabrinutost u sposobnost državnih institucija da ispune obavezu i podrže ljudska prava u brojnim oblastima.

Pozabaviću se tim pitanjem i drugim zabrinjavajućim temama u vezi sa ljudskim pravima kada budem došla u Srbiju, najavila je Mijatović, koja je sa izuzetnom zabrinutošću primetila incident u Novom Sadu kada su pretučena dva momka albanske nacionalnosti.

Ona se nada da će nadležni organi sprovesti efikasnu istragu ovog zločina i da će posvetiti posebnu pažnju činjenici da je mržnja mogući motiv.

Regionalna platforma: Policija da pronađe napadača na kolegu Matorčevića

BEOGRAD, 11.10.2018. – Regionalna platforma za zagovaranje medijskih sloboda i sigurnosti novinara koja zastupa više od 8.000 članova, najoštrije osuđuje fizički napad na Željka Matorčevića, glavnog i odgovornog urednika portala Žig Info.

Željka Matorčevića je u utorak ujutru napao neindetifikovani mladić koji ga je prvo pratio, zatim iznenada udario u potiljak, a kad je Matorčević pao na zemlju nastavio je da ga udara. Matorčević je u napadu zadobio teže tjelesne povrede: polomljena mu je jagodična kost i u narednim danima biće podvrgnut hirurškom zahvatu.

Incident je prijavljen policiji, koja je već preduzela istražne radnje i saslušala povređenog kolegu.

„Podsjećamo da je kolega Matorčević još prošle godine junu mjesecu policiji u Grockoj prijavio prijetnje koje dobija zbog obavljanja svog posla, međutim tim povodom ništa do sada nije učinjeno,“ izjavio je Slaviša Lekić, predsednik NUNS – a, i dodao: „Strepimo da je upravo neefikasnost nadležnih organa u istragama prijetnji novinarima dovela do ovog fizičkog napada.“

Regionalna platforma podržava NUNS i njegove napore da zaštiti novinare i slobodu govora i zahtijeva od policije da po hitnom postupku istraži ovaj napad na našeg kolegu i uhapsi počinioca. Takođe, pozivamo međunarodne organizacije da izvrše dodatni pritisak na vlasti u Srbiji da pokažu punu posvećenost okončanju politike nekažnjivosti u zemlji, osiguraju sigurnost novinara i poštuju slobodu izražavanja i slobodu medija.

Ovo je peti zabilježeni fizički napad na novinare u Srbiji od početka 2018. godine.

Svaki napad na novinare je napad na javni interes, demokratiju i prava svih građana.

Dunja Mijatović: Sloboda štampe i mediji u sve gorem stanju

BEOGRAD, 15.10.2018. – Sloboda štampe i bezbednost novinara su već godinama u sve lošijem stanju a od 1992. godine više od 150 novinara je ubijeno u zoni Saveta Evrope, rekla je komesarka za ljudska prava pri Savetu Evrope Dunja Mijatović.

„Neki od njih su pokrivali ratne priče, međutim, većina ih je ubijena dok su pokušavali da skrenu pažnju na mračne kutke u kojima vladaju korupcija, kriminal i politika“, rekla je Dunja Mijatović u intervjuu za Istinomer.

Ona je dodala da su, nažalost, mnogi političari u najboljem slučaju ravnodušni prema pretnjama koje dobijaju novinari a da su, u najgorem slučaju, oni ti koji huškaju na nasilje i produbljuju nepoverenje prema medijima, što je neprihvatljiva praksa.

Ona je naglasila da je Viktorija Marinova četvrti novinar i treća novinarka ubijena u Evropskoj Uniji od 2017. godine, posle Kim Val, Dafne Karuane Galicije i Jana Kucijaka.

Govoreći o položaju novinara i medija u Srbiji, Dunja Mijatović je kazala da je u stalnom kontaktu sa novinarima, njihovim udruženjima i nevladinim organizacijama koje rade na njihovoj zaštiti.

Ona je naglasila da u Srbiji tek treba da vidimo zadovoljenje pravde u odnosu na slučajeve ubistava koja su se dogodila devedesetih godina.

„Ima nekog napretka, ali to nije dovoljno. Hitno je, ali i moguće da se preokrene ovakva situacija. To zahteva političku volju i konkretne mere koje država treba da preduzme, kao što su efikasan sistem policijske zaštite novinara, nezavisno sudstvo koje je u stanju da kazni počinioce kao i naručioce, te saradnju između državnih organa i nevladinih organizacija, udruženja novinara i nezavisnih nadzornih tela“, rekla je Dunja Mijatović.

Ona je naglasila da deli njihovu zabrinutost u vezi sa situacijom u Srbiji i ostalim zemljama i dodala da je potrebno da se preokrene negativni trend, da se podigne svest o važnosti slobode medija i slobode štampe i nadje najbolji način za rad sa vladama, akademskim zajednicama, industrijom i civilnim sektorom, kako bi društvo postalo osetljivije i prijateljski nastrojeno prema medijima i novinarima.

Odgovarajući na pitanje o nedavnom prebijanju dvojice momaka albanske nacionalnosti u Novom Sadu, Mijatović je rekla da je sa izuzetnom zabrinutošću primetila taj incident, da se nada da će nadležni organi sprovesti efikasnu istragu ovog zločina i da će posvetiti posebnu pažnju činjenici da je mržnja mogući motiv.

Posle Martinovića, i Rističević u Skupštini vređao Nedima Sejdinovića

BEOGRAD, 12.11.2018. – Združena akcija klevetanja novinara u Narodnoj skupštini.

Pred kraj rasprave u Narodnoj skupštini iznete su ponovo optužbe na račun predsednika Nezavisnog društva novinara Vojvodine Nedima Sejdinovića.

Poslanik Narodne seljačke stranke Marijan Rističević govoreći o Sejdinoviću pokazao je i njegovu fotografiju i objavu na Tviteru.

„Kada je u pitanju zagađenje životne sredine moramo progovoriti o duhovnom zagađenju. Ovaj čovek (pokazuje fotografiju Sejdinovića) poznat je po nizu uvreda koje je i danas uputio“, rekao je Rističević, a potom naveo da je Sejdinović „vređao na društvenoj mreži hrišćane“ i „prošao bez ikakve javne osude“.

On je pozvao poslanike da u buduće sve takve navode osude.

Rističević je za Sejdinovića rekao i da je „sastavni deo (Dragana) Đilasovog saveza prevaranata i lopuža“.

Pre toga je i šef poslaničke grupe Srpske napredne stranke Aleksandar Martinović, citirajući stavove Nedima Sejdinovića iznete intervju za Istinomer, rekao da Nedimović ne shvata da je Srbija jedna od najuspešnijih evropskih država i da je treća po stopi rasta u Evropi i da je ekonomski i politički stabilna demokratska država.

„Hoću da kažem da očigledno imamo posla sa ljudima koji ne žele dobro svojoj državi, koji žele da unesu strah i nemir kod gradjana i koji žele da pokvare sve ono što je Srbija dobro uradila u proteklih nekoliko godina“, ocenio je Martinović.

Zbog ovakvih stavova Martinovića, reagovali su Nezavisno udruženje novinara Srbije i Nezavisno društvo novinara Vojvodine.

CoE: Freedom of press declining, journalists endangered

BELGRADE, 12.10.2018. – Dunja Mijatovic, Council of Europe (CoE) Commissioner for Human Rights told the Istinomer website on Friday that the freedom of press and safety of journalists had been deteriorating, while from 1992 over 150 reporters had been killed in the countries within the CoE zone.

Mijatovic added that “unfortunately, some politicians are in the best case indifferent concerning the threats the journalists receive, while in the worst case, they incite violence and deepen people’s mistrust in media, what she described as “an unacceptable practice.”

“Some of the journalists who were killed covered war stories, however, the majority were murdered while trying to investigate the dark world ruled by corruption, crime and politics,” Mijatovic told the website.

Speaking about the media and journalists’ position in Serbia, Mijatovic said she had been in constant touch with them, their associations and NGOs working on their safety, and that she shared their concerns.

“There is some progress, but that is not enough. Such a situation can change. It requests a political will and concrete measures from the state such as a system of police protection of the journalists, independent judiciary able to punish the perpetrators as well as initiators, and the cooperation among state institutions and NGOs and the journalists’ associations and independent regulatory bodies,” Mijatovic said.

She added that Serbia still had to resolve the journalists’ murders from the 1990s.

There is a need for standardization of processes regarding the allocation of public funds to media in BiH

SARAJEVO, 12.10.2018.-Through the work of CPI Foundation (Public Interest Advocacy Center), we collect, check and release all information regarding budget details at all govern- ing levels in Bosnia and Herzegovina, including nonbudget funds.

We often attempted and tried to discover and check certain information, regarding the amount of money that governing official authorities allocate for certain purposes, and to compare this information with non – financial based information and these include the information regarding population statistics in certain areas, number of service users, number of pupils/students in particular areas, number of employees, satisfaction in relation how governing officials manage to fulfill and resolve their problems from their competences point of view etc.), and we couldn’t even complete our research and survey once; we couldn’t determine and confirm amounts of money being subject to our survey or even determine particular percentage included, as far as this survey is concerned.

The reason for this “failure” is most probably the fact that research and survey, regarding money spending by the public sector officials in BiH, has always been considered as rather transcendental, inaccurate and various and different categories usually sums up in the report, creating general confusion. This surely does not happen unintentionally and by accident, as it concerns the governing levels and mechanisms, in regard with government financing biased to war – veteran organizations and associations, including religious communities and naturally, media financing as well.

We are not certain about the amount of money dispersed and aimed directly for the work of private and public media houses, because there are several ways of registering these kinds of transfers, including the following: grants allocated to private enterprises, grants allocated to individuals, grants allocated to organizations, since certain media houses have ties with companies and organizations, financing particular construction works conducted on public buildings and facilities, where the entrepreneur and owner of this building is usually the owner of media house itself, assistance and help aimed to media houses, financing media houses that should monitor the work of municipal administration, monitor financing processes through various greeting commercial advertisements for Christmases, Easters, Eids etc. It is also difficult to follow from which governing levels certain media houses receive grants, funds and get finances.

Moreover, no one is following how much money for announcing miscellaneous announcements and releases in media houses is spent by public enterprises, including vacancy ads, greeting messages and posts, advertisement of different kinds, announcements aimed for their end users (clients), etc. Sometimes, journalists and editors receive certain amounts of finances for additional education. Official politicians are in a position to make an impact regarding the allocation of amounts aimed for media houses for various campaigns financed and funded from both, local/domestic and foreign sources. Media campaigns provide political governing levels with an opportunity to conduct money laundry and to get their hands on cash as well. Arresting and investigations in Croatia proved and confirmed that this is quite easy to conduct and implement and we should suspect that these criminal deeds are present in our country too. In demonstrating the power of control over media houses, we should not just refer to a “carrot, but also to stick”.

Some individuals and governing political parties, including powerful, rich and influential figures, do not hesitate from directing threats, taking revenge and punishing journalists and editors that investigate and write texts, articles or stories that are against their interests. Journalists and editors are therefore very hard to protect from, because the methods of organized crime, pervading with politics, are similar in the whole world. If the vengeance taken against certain journalists would seem easy to identify and recognize by the officials; journalists’ and editor’s family would then consequently become the next victims to be punished instead.

Journalists and editors do not get punished by death, as was the case in European Union, namely in Malta and Slovakia where investigative reporters and journalists were murdered and their murders were ordered by governing officials and mafia members. In this case journalist’s female partner was killed because he was investigating the ties and connections between Calabrian Ndargheta with the Slovakian government regarding the misuses of EU Funds and Grants. Just as there are enough room and space for journalists, editors and media entrepreneurs to protect themselves from pressures, manipulations, threats, and punishments they are being imposed with, we can also see that there are enough room and space for making the present situation worse, by taking over the legal acquis from European Union practice.

We can see that, pursuant to official statements, releases, and reactions by the European Union officials, these kinds of tragic events were taken with regret by the EU officials and that EU officials publically condemned these accidents and associated occurrences; however they failed to provide protection for journalists and we know that no one took legal responsibility and no one was proceeded for murdering a journalist or journalists. According to my knowledge, the case of Zeljko Kopanja has never been terminated and successfully completed, despite the fact that all services, both local and foreign, were engaged with this case and involved in the investigation process. This was the case of a car bomb assassination attempt on Zeljko Kopanja, who, as a result of severe injuries, lost both his legs and lived as disabled person, which deprived him of normal life.

In this text, we shall take a look and review social media field; platforms falsely presented as something else, rather than media houses, so they could eventually avoid material and moral responsibilities for media announcements and releases in media that actually announce these kinds of announcements, releases, and statements. Although glorified at the beginning, as a tool for netting positive, affirmative, progressive society forces, as arms required for the democratization of totalitarian or authoritarian societies with numerous democratic deficits, they have quickly transformed into something opposite, namely they transferred into the tool of conservative and reactional forces, opponents of human rights, minority rights, migrants rights, women reproductive rights, science opponents cleverness, ecology, vaccine and common sense in general.

They also proved to be very effective, easy to handle and use and with great effect in regard to what had been invested. Greatest and best settled and arranged country systems (USA, United Kingdom, and Germany) have not been able to resist negative effects deriving from social media and accordingly making an impact on democratic processes, elections, and referendums, and I am therefore convinced that the chances of BiH having settled this field are minimized. Under such conditions, where regularity of election or referendum processes and prevention of manipulation of voters cannot be ensured, certain questions and issues emerge, such as: What is the next stage, which system of participation of citizens in election and control of governments shall be introduced, because the elections process at present, that is, as with fair and honest method, is definitely over.

Until all issues are resolved and particular but serious reforms emerge at a global level, which shall hopefully include our country, perhaps thorough pre-accession processes, we cannot stand still; do nothing about this issue and despair. There are numerously accepted and implemented recommendations that may serve as steps in the right direction in order to provide and ensure fair and transparent media environment in BiH. Standardization of processes regarding the allocation of public financial means that would consist of public invitations, public applications, public valuing of applications, public selection of media that are entitled and deserve to be funded, financed, donated or granted, following, measuring and monitoring of accomplished results and effects is possible to obtain.

Failing to follow and fulfill the above-mentioned standards should consequently result in fining and penalizing media houses, including penalizing public administrative body that was in charge with allocation process of financial means granted to that media house and finally, fining all persons responsible in this entire process. Public media houses should be included in regular budget planning procedures, but they should also be obliged to abide defined limits of commercial contents. At present, many of them still receive grants on an ad hoc basis and this is simply a shorter halter for better and more efficient media control.

Complete ownership media structure of all media houses and all ties and connections with legal and physical entities shall, during this and previous year, proactively be posted on official media websites. All state budgets at all levels, or at least on Entity levels and districts shall be unified and their spending shall be channeled pursuant to professional rules; for optimal range of target groups with minimum investments toward verified information regarding audience viewership, listening and reading information.

State bodies, regulatory bodies, police and judicial bodies cannot remain passive and observe anomalies occurring on social media pages where (with reasonably limited investments) a great damage (in terms of posting false and incorrect news) can be caused as result, including encouraging specific groups to lynch an individual or groups and common public backwardness. Skilled professionals working in institutions and agencies must start with the direct launching of effective communication-based channels with largest networks and legal experts must start working thoroughly on legislative framework regarding the regulation of social media and networks and also start creating the legal foundation for strategic litigation.

Without this proactive conduct by the governing official authorities, physical and legal entities in BiH, participants of political processes, entrepreneurs, businessmen, journalists, and activists shall remain unprotected and this is exactly where I see the biggest threat for media houses in BiH, including media employees and including media influence and impact on democratic processes in BiH.

БЕЛГРАД, 12.10.2018 – Регионалната платформа на Западен Балкан за застапување на слободата на медиумите и безбедноста на новинарите која претставува повеќе од 8000 членови, остро го осудува физичкиот напад кој се случи врз колегата Жељко Маторчевиќ, одговорен уредник на порталот Zig info. 

Жељко Маторчевиќ беше нападнат од неидентификуван млад човек во вторникот наутро, кој првo го следел, а потоа ненадејно го удрил во главата нашиот колега, а кога Маторчевиќ паднал на земја, тој продолжил да го удира по телото и лицето. Маторчевиќ претрпе сериозни повреди на телото: му беше скршена јаболчницата на лицето и во наредните денови се очекува да му биде извршен хируршки зафат.

Инцидентот беше пријавен во полиција, која веќе презела истражни дејствија и го сослушала повредениот колега.

“Потсетуваме дека Маторчевиќ минатата година пријави закани што ги доби поради својата новинарска работа во полицијата во Грочка, но досега од нивна страна ништо не е направено”, рече Славица Лекиќ, претседател на НУНС, и додаде: “Загрижени сме поради неефикасноста на институциите при истражување на заканите кон новинарите, која подоцна доведува до вакви физички напади“.

Регионалната платформа го поддржува НУНС во своите напори за заштита на новинарите и слободата на изразувањето и бара од полицијата итно да го истражи овој напад врз нашиот колега и да го уапси сторителот.

Исто така, ги повикуваме меѓународните организации да извршат дополнителен притисок врз властите во Србија да покажат целосна посветеност за да се стави крај на политиката на некзнивост во оваа земја, да се зголеми безбедноста на новинарите и да се почитува слободата на изразување и медиумите.

Ова е петти физички напад на новинарите во Србија од почетокот на 2018 година.

Секој напад врз новинарите е напад врз јавниот интерес, демократијата и правата на сите граѓани.
